PRESS RELEASE – 134th SESSION OF THE COMPETITION COUNCIL OF BOSNIA AND HERZEGOVINA

 

134th session of the Competition Council was held in Sarajevo on 3 November with the following adopted:

Decision establishing that the undertaking Ekopak d.o.o., company for the treatment of packaging waste, Sarajevo, prevents, restricts and distorts market competition in the field of assignment of the right to use the international trademark “Green Dot” on the packaging/ labeling of products on the market in Bosnia Herzegovina, in the way that undertakings that manage and dispose packaging waste through undertaking Ekopak have certain benefits in terms of obtaining and using the sign ,, Green dot “, while the same benefits are not available to customers of their competitors, and thus it abused a dominant position by applying different conditions for the same or similar transactions with other parties, within the meaning of Article 10 paragraph (2) c) of the Law. The decision prohibits any further conduct of the undertaking Ekopak d.o.o., company for treatment of packaging waste, in terms of abuse of a dominant position. Undertaking Ekopak d.o.o. was ordered to comply its operation within fifteen (15) days from the receipt of the decision in the way that would completely separate the management of packaging and packaging waste from the assignment of the right to use the international trademark “Green Dot”, and to ensure that all interested undertakings have equal access to benefits and the assignment of the right to use the sign ‘’Green dot”, and exclude additional benefits to their customers or clients that manage and dispose packaging waste through undertaking Ekopak during the assignment of the right to use the sign ,, Green dot”, and thereby provide equal conditions for all undertakings in the relevant market. The Decision also fined undertaking Ekopak d.o.o., company for the treatment of packaging waste, for infringing provisions of the Law on Competition, in the amount of BAM 6,500.00.

Decision allowing the concentration in the market of heavy and light colored scrap metal as well as market of collection/processing of heavy and light colored metal waste in Bosnia and Herzegovina that will result from acquisition of control of undertaking Chiho-Tiande Group Limited, Cricket Square, Hutchins Drive, PO Box 2681, Grand Cayman, Cayman islands, over the undertaking Scholz Holding GbmH, Essingen, Republic of Germany by purchasing 100.0% of ownership stake.
