
PRESS RELEASE 34th session
The Competition Council of Bosnia and Herzegovina, at its 34th session held on 30 September 2025 in Sarajevo, reviewed materials in the field of competition law and policy, as well as the internal work and functioning of the Competition Council.
The following decisions were made at the session:
– Decision was made rejecting as unfounded the Claim of the undertaking “Unifarm” d.o.o. Lukavac, filed against the Government of the Herzegovina-Neretva Canton, for the purpose of adopting a Decision amending and supplementing the Decision on determining the list of medicines prescribed and dispensed at the expense of the funds of the ZZO HNK, in accordance with the provisions of Article 4, paragraph (1), item b) of the Law on Competition.
– At the Claim of the undertaking “Sarajevo – gas” a.d. East Sarajevo, Decision was issued in accordance with Article 11, paragraph (3), and in connection with Article 11, paragraph (2) of the Law on Competition, in the proceedings initiated upon the Request of the undertaking “Energoinvest” d.d. Sarajevo against the undertaking “Sarajevo – gas” a.d. East Sarajevo, in order to determine the existence of an abuse of a dominant position.
– The proceedings initiated against the undertaking “Euroterm” d.o.o. Kiseljak were suspended, after the Claimant withdrew its Claim for determining the abuse of a dominant position.
– The conclusion rejected the Notification of Concentration of the undertaking “Cosnova Beauty” GmbH, Zulcbah Taunus Germany, due to the absence of an obligation to notify the concentration in terms of Article 14, paragraph (1) of the Law on Competition.
– The proceedings upon the Notification of Intention to Concentrate of the undertaking “Aktiva invest” d.o.o. Banja Luka were suspended, due to the withdrawal of the party.
– The proceedings initiated upon the Claim of the undertaking “Eol Petrol” d.o.o. Sarajevo against the undertakings “Hifa-Oil” d.o.o. Tešanj and J.P. “Međunarodni aerodrom Sarajevo” d.o.o.
– The Request of the undertaking “Unifarm” d.o.o. Lukavac was considered, for an opinion on whether the Decision on determining the prices of municipal waste collection services for economic entities, issued by JP “Rad” Lukavac, is in compliance with the provisions of the Law on Competition.
Since the contested decision is not an act whose proponent submitted a draft or proposal to the Competition Council in accordance with the Law, in this case it was not possible to give an opinion on its compliance with the Law on Competition.
– An Opinion was issued, that the Proposal of the Decision on amending the Decision on the organization and manner of performing taxi passenger transport in the Una-Sana Canton is in compliance with the Law on Competition.
– An Opinion was issued upon the Request of the undertaking Optima Grupa d.o.o. Banja Luka, on the existence of an obligation to notify a concentration.
– The Preliminary Draft Law on Postal Services of Bosnia and Herzegovina was considered. After considering the submitted documentation and facts, the Council took a position and adopted an Opinion that the Preliminary Draft contains certain solutions that deviate from the EU directives in the field of postal services and the principles of free competition. Such solutions represent an obstacle to market development and call into question compliance with the EU acquis and the Law on Competition.
– At the request of the State Electricity Regulatory Agency, the Competition Council adopted an Opinion that the Draft Decision on amendments to the Methodology for the preparation of tariffs for electricity transmission services, the work of the independent system operator and ancillary services is in compliance with the Law on Competition.
Within the remaining items on the agenda of the session, the Operational Action Plan for the Development of the Financial Management and Control (FMC) System for 2025 was adopted, and a Working Group was appointed to prepare a draft Decision on amendments to the Decision on the Amount of Administrative Fees in Relation to Procedural Actions before the Competition Council of Bosnia and Herzegovina (“Official Gazette of BiH”, No. 30/06, 18/11 and 75/18).
