PRESS RELEASE 9th session

The Competition Council of Bosnia and Herzegovina iheld its 9th session in Sarajevo on July 1 2024. The session was preceded by a working meeting.
Materials from the field of competition law and politics, as well as the internal work and functioning of the Competition Council, were discussed at the session.

The notification of concentration at the request of the natural person Svjetlan Stanić from Kiseljak, with which he intends to acquire control over Bihaćka pivovara d.d. Bihać was rejected, due to the non-existence of the obligation to report the concentration in the sense of Article 14, paragraph (1) of the Law on Competition.

The request of the undertaking “SBK ART LLC” Moscow, Russian Federation, for recognition of the status of a party in the process of concentration of undertaking “Open Pass Limited” Malta and “Fortenova Group MidCO B.V” Amsterdam, Netherlands, was rejected as premature.
An Opinion was issued based on the request of lawyer Nihad Odobašić from Sarajevo, where the actions of the hypothetical situation of concluding an exclusive contract between two unknown undertakings were described. In the Opinion, it is stated that the Competition Council of BiH is unable to establish the existence of prohibited competitive activity without providing actual data and necessary documentation.

Also, an Opinion was adopted based at the Request of the Association of Families with Infertility Problems “Roda” from Banja Luka. Based on the data submitted in the Request, the BiH Council of Competition is of the opinion that the Agreement on the provision of services and co-financing of biomedically assisted fertilization procedures, concluded between the Health Insurance Fund of the Republika Srpska and the specialist gynaecological clinic “Medico-S” from Banja Luka, does not constitute prohibited competition action from the Law on Competition, including the prohibited agreement from Article 4, paragraph (1) of the Law on Competition.

Als, an Opinion was adopted at the request of the Ministry of Communal Economy, Infrastructure, Spatial Planning, Construction and Environmental Protection of the Canton of Sarajevo, which assessed that the Draft Rulebook on conditions for the performance of energy activities of production and supply of thermal energy is in compliance with the Law on Competition.
