PRESS RELEASE 40th session

The Competition Council of Bosnia and Herzegovina, at its 40th session, held on 18 February 2026 in Sarajevo, considered the following materials in the field of competition law and policy.
The request for initiation of proceedings by the undertakings Premier world sport d.o.o. Čitluk, Bet-live d.o.o. Vitez, Petica plus d.o.o. Vitez, Sport plus d.o.o. Novi Travnik and Sport plus win d.o.o. Novi Travnik, filed against the City of Bihać, was rejected due to lack of actual jurisdiction.

The claim was filed to determine the existence of a prohibited agreement under Article 4, paragraph (1) of the Law on Competition, which refers to the provisions of the Decision on Utility Fees and the Utility Fee Tariff (”Official Gazette of the City of Bihać”, No. 5/24 and 8/25).

The procedure for the Notification of the concentration of the undertaking OPTIMA Grupa d.o.o. Banja Luka has been suspended, due to the withdrawal of the party.

The Application of the intention of concentration of the undertaking “Telekomunikacije Republika Srpska” a.d. Banja Luka was rejected, due to the non-existence of the obligation to report the concentration in the sense of Article 14, paragraph (1) of the Law on Competition.

Opinion was issued at the Request of the Ministry of Education, Science, Culture and Sports of the Zenica-Doboj Canton, on the Proposal of the Law on Preschool Education.

An Opinion was also adopted upon the Request of the Federal Ministry of Internal Affairs on the Proposal of the Rulebook on the criteria for checking the health capability of persons performing tasks of protecting people and property.
After the analysis, it was concluded that certain provisions of the Proposal of the Rulebook may have a negative impact on market competition, because they represent a regulatory barrier to market entry that is neither necessary nor proportionate to the set goal, and as such are not fully aligned with the principles of protection of market competition from the Law on Competition.

Opinion was adopted upon the Request of attorney Dario Popović from Teslić, on the obligation to submit a concentration notification.

Within the remaining items on the agenda, the Draft Report on the Work of the Competition Council of BiH for 2025 was adopted, as well as the Report on the Implementation of the Operational Action Plan for the Development of the Financial Management and Control System (FMC) for 2025.
