PRESS RELEASE – 75th SESSION OF THE COUNCIL OF COMPETITION OF BOSNIA AND HERZEGOVINA
75th session of the Council of Competition of Bosnia and Herzegovina was held in Sarajevo on 9th December 2013 with the following adopted:
Decision to dismiss the Request to delay the execution of the final Decision of the Council of Competition of Bosnia and Herzegovina, No. 02-26-3-18-157-II/12 of 20th November 2013.
Decision No. 02-26-3-18-157-II/12 of 20th November 2013 determined that the undertaking Apatinska pivara Apatin d.o.o., Trg oslobođenja 5, 25260 Apatin, Serbia , refusing to sign the Sale- Purchase Agreement for the year 2012 with the undertaking Preduzeće za spoljnu i unutrašnju trgovinu i usluge Dejan komerc d.o.o., Ozrenskih srpskih brigada 38A, 74000 Doboj, abused its dominant market position in the distribution and sale of beer in the territory of the Republic of Srpska , because it applied different conditions for the same or similar transactions with other parties , thereby placing the undertaking Dejan commerce d.o.o. Doboj in an unequal position in the market.
For the mentioned infringement of the Competition Act, Council of Competition of Bosnia and Herzegovina, among other obligations, has imposed a fine on the undertaking Apatinska pivara d.o.o. Apatin, in the amount of 430.000,00 KM .
When deciding on the Request, it was found that undertaking Apatinska pivara d.o.o. Apatin has not cited any relevant facts or submitted relevant evidence that Council of Competition would consider justified and critical to the decision to delay the execution of the mentioned Decision.
