Press Release 39th session
The Competition Council of Bosnia and Herzegovina, at its 39th session, held on 16 January 2026 in Sarajevo, reviewed materials in the field of competition law and policy and made the following decisions:
Decision was made at the session, establishing that the Federal Ministry of Internal Affairs and the Federal Ministry of Health, by adopting and implementing Article 4 of the Rulebook on the Criteria for Checking the Health Capabilities of Persons Performing Human and Property Protection Tasks (“Official Gazette of the Federation of Bosnia and Herzegovina” No. 32/15), concluded a prohibited agreement within the meaning of Article 4, paragraph 1, item b) of the Law on Competition The aforementioned actions limited and distorted competition in the market for providing services for checking the health capabilities of persons performing human and property protection tasks in the territory of the Federation of Bosnia and Herzegovina.
The Federal Ministry of Interior and the Federal Ministry of Health were ordered to amend Article 4 of the Rulebook on the criteria for checking the health capacity of persons performing human protection tasks, in such a way that all health institutions that meet the prescribed conditions from Article 3 of the Rulebook enable the performance of health capacity checks of persons performing human and property protection tasks in the territory of the Federation of Bosnia and Herzegovina.
By adopting the decision in question, the Competition Council imposed a fine on the Federal Ministry of Interior and the Federal Ministry of Health in the total amount of 20,000.00 KM, for concluding a prohibited agreement.
An individual exemption was established for the agreement relating to the Agreement on the purchase and sale of shares in the target company Banjalučka pivara d.o.o. Banja Luka, concluded on 9 September 2025 between the undertakings Olvi Oyj Iisalmi, Finland, and Altima UK Value Investments Limited Harbour Place, Cayman Island, within the meaning of Article 4, paragraph (1) and (3) and Article 5 of the Law on Competition. The exemption is established for a period of three (3) years and is valid from the date of conclusion of the agreement in question.
The notification of the concentration of the undertaking Saxophone Germany BidCo GmbH was rejected, due to the absence of the obligation to notify the concentration within the meaning of Article 14, paragraph (1) of the Law on Competition.
The notification of the concentration of the undertakings Franck d.o.o. Sarajevo and Branck Caffe d.o.o. Broćanac was rejected, due to the absence of the obligation to notify the intention to concentrate, within the meaning of Article 14, paragraph (1) of the Law on Competition.
The procedure was initiated upon the request for individual exemption of the agreement from the prohibition, submitted by the undertakings Philip Morris Product S.A. Neuchatel, Switzerland and British American Tobacco Exports Limited London, United Kingdom.
The procedure was suspended upon the notification of the concentration submitted by the undertaking Aktiva invest d.o.o. Banja Luka, due to the withdrawal of the application.
Opinion was issued upon the request of the Public Procurement Agency on the Preliminary Draft Law on Public Procurement.
Opinion was adopted at the request of the undertaking Hidroelektroenergetski sistem “Gornja Drina” d.o.o. Foča, which relates to the openness of the electricity market in Bosnia and Herzegovina in the production and trade segment.
Opinion was adopted at the request of the Association of Importers and Traders of Motor Vehicles in the FBiH, Živinice, regarding the application of the Regulation on products that become a special category of waste after use and the criteria for calculating and paying fees (“Official Gazette of the FBiH” No. 59/21) and its compliance with the Law on Competition.
Within the remaining items on the agenda, the Report on the implemented internal control procedure for 2025, the Annual Report on Financial Management and Control for 2025, as well as the Summary Report on implemented control activities for 2025 were considered. Also, the Public Procurement Commission for 2026 was appointed.
