PRESS RELEASE 8th SESSION OF THE COMPETITION COUNCIL OF BiH
The eighth session of the Competition Council of Bosnia and Herzegovina started in Sarajevo on 31 July 2017, and continued on 4 August 2017, with the following adopted:
Decision alowing the concentration that will arise in the relevant wholesale market of dry construction mortar, dry facade mortar, pasty facade mortar and adhesive mortar throughout the territory of Bosnia and Herzegovina, by which Baumit Beteiligungen GmbH, Waldegg, Austria acquires a 100% stake in the company w & p Baustoffe GmbH, Klagenfurt, Austria, and the trademarks and domains of BAUMIT and KEMA, which are all part of building materials sector of the Wietersdorfer Group.
Conclusion initiating a procedure for assessment of a concentration within the meaning of Article 17 and 18 of the Law on Competition concerning the acquisition of exclusive control over business activities related to phosphate for animal foods of the undertaking Elixir Prahovo, Chemical Products Industry Prahovo, Prahovo, R. Serbia by the undertaking Timab Industries SAS, Dinard, R. France within the meaning of Article 12 paragraph (1) point (b) of the Law on Competition.
Opinion on the Claim of the undertaking Mješoviti Holding “Elektroprivreda Republike Srpske” Parent company a.d Trebinje. According to the adopted opinion, the Competition Council considers that in the present case there is no obligation to notify the concentration within the meaning of Article 16, paragraph (1) of the Law, whereas the notification of the intention of the concentration can be submitted in accordance with Article 16, paragraph 2 of the Law, if the conditions from Article 12 (form of concentration) and Article 14 of the Law are met.
Opinion on the Claim of the undertaking Amko Komerc d.o.o., Sarajevo, on the existence of the obligation to file a notification of a concentration. The Competition Council , by applying the said provisions, on the basis of data provided by the Claimant, found that the conditions from Article 12 of the Law on Competition were not fulfilled, that is, that the said consentration was not considered a concentration, and that therefore there was no obligation to notify it.
