
PRESS RELEASE 24th session
The Competition Council of Bosnia and Herzegovina, at its 24th session held on 20 March 2025 in Sarajevo, discussed materials in the field of competition law and policy, as well as the internal work and functioning of the Competition Council.
A Decision was issued allowing individual exemption from the prohibition of the Agreement between “Schneider Holding GmbH” Fronhausen, Germany and natural persons from Bosnia and Herzegovina, within the meaning of Article 4, paragraph (3) and Article 5 of the Law on Competition.
A Decision was issued whereby the Request of the Association of Private Postal Operators Sarajevo, filed against the undertakings JP “BH Pošta” d.o.o. Sarajevo, “Pošte Srpske” a.d. Banja Luka and JP “Hrvatska pošta” d.o.o. Mostar was rejected in its entirety as unfounded. It related to the determination of the existence of a prohibited agreement within the meaning of Article 4, paragraph 1, items a) and d) of the Law on Competition, the determination of the existence of an abuse of a dominant position within the meaning of Article 10, paragraph 2, items a) and c) of the Law, as well as the infringement of Article 9, paragraph 1, items a), b), c), and g) of the Decision on defining the categories of dominant position, and the determination of the existence of a prohibited concentration within the meaning of Article 13, in accordance with Article 12, paragraph 1, item c) of the Law.
In the proceedings conducted upon the Request of the undertaking “CT-Trade BH” d.o.o. Tuzla, a Decision was issued establishing that the undertaking “JP Centralno grijanje” d.d. Tuzla committed an infringement of Article 10, paragraph (2), item d) of the Law on Competition, by applying the Technical Conditions for Connection to the District Heating System and Delivery of Heat Energy dated 09.12.2021 (which were partially amended and supplemented on 09.10.2023), placed conditions to the other party to accept additional obligations that by their nature have no connection to the subject of the agreement.
The undertaking “JP Centralno grijanje” d.d. Tuzla was ordered to adjust, within 60 (sixty) days from the date of receipt of the Decision, the Technical Conditions for Connection to the District Heating System and Delivery of Heat Energy dated 09.12.2021., in accordance with point 1 of the enacting clause, as well as to publish the changes on its official website, and inform users thereof.
Due to the violation of the provisions of Article 10, paragraph (2), item d) of the Law on Competition, a fine was imposed on the undertaking “JP Centralno grijanje” d.d. Tuzla, in the amount of 5,000.00 KM (five thousand and 00/100 KM).
The proceeding was initiated, upon the request of a natural person, against the undertaking “Euroterm” d.o.o. Kiseljak, in order to determine the abuse of a dominant position within the meaning of Article 10, paragraph (2), items a) and c) of the Law on Competition.
The Conclusion rejected the Application of the Public Institution “Employment Service of the Sarajevo Canton”, due to the lack of conditions for initiating the procedure ex officio.
An Opinion was issued upon the request of the Ministry of Communal Economy, Infrastructure, Physical Planning, Construction and Environmental Protection of the Sarajevo Canton, on the Proposal of the Decision on determining the tariff categories of natural gas buyers with the prices of the municipal service of natural gas supply by KJKP “Sarajevogas” d.o.o.
An Opinion was issued upon the request of the Company for the Management of the European Voluntary Pension Fund a.d. Banja Luka, Bosnia and Herzegovina, on the obligation to notify the concentration.
An Opinion was adopted upon the request of the Public Health Institution “Apoteka Gradiška” Gradiška, Vidovdanska 11, 78400 Gradiška, regarding the obligation to apply the Public Procurement Law.
Within the remaining items on the agenda of the session, the Anti-Corruption Plan in the Competition Council for the period 2025–2028 and the Report on the List of Receivables and Liabilities as of 31.12.2024 were adopted.
